Terms & Conditions:
1. ELIGIBILITY. This Contest (the “Contest”) is open to U.S. residents (excluding Arizona) age 18 or older. In order to enter the contest, you must agree to these Official Rules (“Rules”). You agree that submission of an entry in the Contest constitutes agreement with these Rules. Employees, directors, officers and principals of Collette, its subsidiaries, affiliates, contractors, agents and members of their immediate families or households are not eligible to participate or win a prize. Collette reserves the right to verify eligibility and to adjudicate on any dispute at any time. CONTEST IS VOID WHERE PROHIBITED.
2. SPONSORS. The Sponsor of the 2014 Collette Photo Contest is Collette Travel Service, Inc., 162 Middle Street, Pawtucket, Rhode Island 02860.
3. HOW TO ENTER. For digital upload, participants who have traveled with Collette after June of 2012 can visit the Trip Page when logging into their Collette Gateway account. For participants who have not traveled with Collette or have traveled prior to June of 2012 can enter by sending photos on a DVD, CD, or USB to: Collette Marketing Department – Photo Contest, 180 Middle Street, Pawtucket, RI 02860. Please send highest resolution available. Only minor alteration or color correction is acceptable, as is cropping.
Photos should be identified with the location and names of any passengers in the photo. Mailed in entries must contain a signed release form.
All entries completed correctly will be eligible to win one of the prizes listed below.
4. PROMOTION PERIOD. The Contest starts at 12:00 a.m. Eastern Standard Time on June 30, 2014 and ends at 11:59 p.m. Eastern Standard Time on December 31, 2014 (the “Promotion Period”). All entries must be received no later than 11:59 p.m. on December 31, 2014. Limit one entry per person containing no more than ten (10) photographs. All entries submitted become the sole property of Collette and will not be returned. We reserve the right, in our sole discretion, to disqualify any entrant or image.
5. SELECTION OF WINNERS. The theme of the contest is “My Travel Moment”. At Collette, travel is about so much more than going places. Our world contains so many experiences for us to enjoy. But there’s one thing those adventures – the brilliant sunsets, the lost cities, the soaring peaks, the dramatic landmarks, and the incredible meals – all share. They remind us what life is all about. It is about being a part of something greater. Along with aesthetic considerations, images are judged on the ability to capture these feelings during a personal travel experience.
After the closing date, contest judging consists of four rounds. All judging is based on the criteria above. During round one, submissions are judged by a Collette media specialist, narrowing the finalists down to about 50-100 photographs. The media specialist must have at least 2 years experience in the travel industry. In round two, the remaining photos are presented to Collette's Advertising Team, who judge the images and select the top 10 finalists. Collette’s Advertising Team must have at least 2 years experience each in a creative career, including but not limited to Graphic Design, Video, Copy, and/or Web. In round three, an executive committee, consisting of the Vice President of Marketing and the Vice President of Product, select the top 3 finalists. The Vice President of Marketing and the Vice President of Product must have at least 2 years experience in the travel industry and at least 5 years experience in a management role. In the fourth and final round, the public is able to vote on their favorite photo via Collette’s Facebook page. A “like” on the Collette Facebook page is required for voting. The public will decide the first, second, and third place winner based on number of votes. In the case of a tie, the tiebreaker will be decided by Collette’s VP of Marketing. The tiebreaker will be based on the photo that best fits the judging criteria above. All decisions are final and binding.
The final 3 finalists will be notified via phone and/or email by February 6, 2015. The social media voting on Facebook will begin on February 9, 2015 at 10:00am EST and close on February 13, 2015 at 5:00pm EST. Winners will be notified via email and phone by February 20, 2015. Decisions of the Judges are final and binding.
Winners will be posted on but not limited to Collette’s Facebook page, website, email blast, press release, and other social media outlets.
6. PRIZES: Number of Prizes: 3. 1 Grand Prize winner, 1 2nd place winner, and 1 3rd place winner. The Grand Prize consists of six nights in Santorini, Greece for 2 including hotel and airfare from your gateway city. This is an independent prize and not part of a standard Collette tour. The 2nd Place winner will receive an $800 Travel Credit for future travel with Collette. The 3rd Place winner will receive a $400 Travel Credit for future travel with Collette.
Travel Credits have no cash or refundable value. Travel subject to availability and all travel restrictions. Travel Credits are non-transferable/ non-endorsable / non-refundable. Travel Credits are good for 12 months from date of issue at the initial value. After 12 months, Travel Credits are invalid and cannot be used toward travel. Travel Credits are not redeemable during “black-out” periods. Travel Credits cannot be used for deposit and is for final payment only. Travel Credits are valid for new reservations only. Any changes to the reservation once booked are subject to change fees and are to be paid by the recipient.
7. GENERAL CONDITIONS. Winners will be notified by e-mail or telephone before the February 20, 2015 announcement. In the event of noncompliance, if the winner cannot be reached at the telephone number submitted with entry, or if the prize or prize notification is returned as unclaimed or undeliverable, the prize will be forfeited and an alternate winner will be selected.
If the grand prize has been forfeited, the 2nd place winner based on Facebook votes, will become the grand prize winner. The 3rd place winner, based on Facebook votes, will become the 2nd place winner. The alternate 3rd place winner will be decided by Collette’s VP of Marketing based on the judging criteria in section 5.

The tiebreaker will be based on the photo that best fits the judging criteria listed in section 5. The Vice President of Marketing must have at least 2 years experience in the travel industry and at least 5 years experience in a management role. All decisions are final and binding. No cash alternative or substitution of any prizes will be offered. No prize transfer is permitted. Limit one prize per person. Participants agree to be bound by these Official Rules and the decisions of Collette are final and binding in all respects.
8. ENTRANT LICENSES & RELEASES. By submitting photography and by entering the Contest, to the extent permitted by law, entrant grants to Collette, free of charge, a non-exclusive, perpetual, worldwide royalty-free license to modify, rearrange, copy, reproduce, distribute, display and adapt the images in the photo submitted, to publish and use of the photograph submitted and the content of and elements embodied in the photographs, including any names, locations and likenesses, in any and all media including but not limited to digital and electronic media, computer and audiovisual media, in any of its advertising and promotional materials, in any language throughout the world in any manner without further review, notice, approval, consideration or compensation. By participating and accepting a prize, so long as there is no legal prohibition, winner agrees that Collette may use his/her name for advertising or publicity purposes. Winner also agrees that Collette may use statements made by or attributed to him/her relating to Collette and/or this promotion, and releases any and all rights to said use without further compensation.
If recognizable people are portrayed in a photo, the subjects must have given the photographer written permission to have the photograph taken and used by Collette as outlined herein without additional consideration. If recognizable children are portrayed, the subject’s parent/guardian must have given the photographer written permission to have the photograph taken and used by Collette as outlined herein without additional consideration.
9. WARRANTY & INDEMNITY. (a) Entrants warrant that their Photographs are their own original work and, as such, they are the sole and exclusive owner and rights holder of the submitted Photographs and that they have the right to submit the Photographs in the Contest and grant all required licenses. Each entrant agrees not to submit any entry that (1) infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret, privacy, publicity or confidentiality obligations; or (2) otherwise violates the applicable state, federal, provincial or local law. Entrants also warrant that they have not submitted their entry on behalf of a team or any other entity.
(b) To the maximum extent permitted by law, each entrant indemnifies and agrees to indemnify Collette at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the entrant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, each entrant agrees to defend, indemnify and hold harmless Collette and its employees, agents, directors, officers and principals, from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or accruing from (a) any Photographs or other material uploaded or otherwise provided by the entrant that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person or defames any person or violates their rights of publicity or privacy, (b) any misrepresentation made by the entrant in connection with the Contest; (c) any non-compliance by the entrant with these Rules; (d) claims brought by persons or entities other than the parties to these Rules arising from or related to the entrants involvement with the Contest; (e) acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest; (f) any malfunction or other problem with the Contest Site; (g) any error in the collection, processing, or retention of entry information; or (h) any typographical or other error in the printing, offering or announcement of any prize or winners.
9. RIGHT TO CANCEL, DISQUALIFY AND SUSPEND CONTEST. (a) Collette reserves the right to disqualify any entrant from the contest, if in Collette sole discretion, it reasonably believes that the entrant has violated these Rules, or has attempted to undermine the legitimate operation of the Contest by cheating, deception or unfair play or practice.
(b) If, for any reason, the Contest is not capable of running as planned, including without limitation infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Collette which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Collette reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest.
10. LIMITATION OF LIABILITY. Collette is not responsible for entries that are corrupted or otherwise not received correctly or for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of email, or on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in the Contest. Collette assumes no responsibility for any incorrect or inaccurate information, whether caused by web site users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of submissions in the Contest.
Collette assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, including lost, late or misdirected entries.
10. COMMUNICATIONS: By participating in the Contest, you will opt-in to receive email or other communications from Collette. You may subsequently opt-out of the receipt of such email or communications. Your opt-out status will not affect your participation or chances to win in the Contest. During the Promotion Period, however, you may nevertheless receive emails which Collette deems are related to the Contest and related programs.
11. CHOICE OF LAW. This contest is subject to federal, state and local laws and regulations. Certain restrictions may apply. Entrant agrees that any and all disputes that cannot be resolved shall be before a Federal or State Court of competent jurisdiction in the State of Rhode Island and that the laws of the State of Rhode Island shall apply to any dispute.
12. TAXES. All federal, state and local taxes, fees and surcharges on prize packages are sole responsibility of winners. Winners will be issued an IRS Form 1099 for appropriate approximate retail value of a prize, if applicable.
